1. Who we are

DAAAM is a sole trader business operated by Munashe Chitima, Melbourne, Victoria, Australia. "DAAAM", "we", "us", "our" refers to this business. "You" or "User" refers to the person accepting these Terms.

2. The Services

DAAAM is a local-first digital asset management tool for filmmakers and photographers. It ingests your media, extracts proxy frames on your device, uses AI to make your library searchable, and stores everything in a local database. Cloud Vision is an optional feature that sends proxy frames (not your originals) to our servers for AI captioning, billed against cloud footage-hours you purchase.

3. License activation and account

The App requires a valid DAAAM licence key:

• Your license is one-time and perpetual, including one year of free updates from purchase date.
• Verified offline via Ed25519 digital signature: works without internet for all local features.
• Valid for up to 2 devices. Deactivate a device in Settings → Account to free a seat.
• Keep your licence key confidential. You are responsible for all activity under it.

We may revoke a licence for breach of these Terms.

4. Cloud Vision: how it works

When you choose "In the cloud" analysis, the App sends compressed proxy frames (JPEG, not your originals) to our control plane, which calls Google Gemini and returns captions. Your originals never leave your Mac. Proxy frames are processed in real time and not retained after the API call completes.

Cloud Vision requires a funded balance of footage-hours. When your balance reaches zero, Cloud Vision stops. All billing is enforced server-side. Editing local files cannot increase your balance.

5. Cloud hours: purchase and billing

• No subscription, no auto-renewal. You only pay when you choose to buy more hours.
• Welcome credit: Every new licence activation gets 30 free footage-minutes (0.5 hours).
• Hours don't expire. Purchased hours remain on your account indefinitely.
• Prices are exclusive of applicable taxes. You are responsible for any VAT, GST, or sales tax.

6. Refunds

• DAAAM app ($69): Full refund within 14 days of purchase if you haven't activated the licence. Contact support@daaam.media.
• Unconsumed cloud hours: Full refund within 14 days of purchase if no hours from the pack have been used.
• Consumed cloud hours: Not refundable. These represent actual AI compute we incurred on your behalf.
• Welcome credits: Not refundable (they are free).
• Statutory rights: Nothing here limits any refund right you have under applicable consumer-protection law, including the Australian Consumer Law.

Valid refund requests are processed within 10 business days. Email support@daaam.media with your order details.

7. Acceptable use

You must not use the Services to process unlawful content, circumvent our metering or authentication, resell access to Cloud Vision, or violate any applicable law. We may suspend access for violations.

8. AI Output disclaimer

AI captions, tags, and transcripts are generated automatically and may be inaccurate. They are not factual records and must not be relied on for legally or commercially critical purposes without verification. We disclaim all liability for consequences of relying on AI Output.

9. No biometric processing

DAAAM does not perform facial recognition and does not generate biometric data. Cloud Vision produces descriptive captions; it does not identify who any person is.

10. Your data stays local

Your original media files, local database, proxy frames (except during active Cloud Vision calls), transcripts, GPS data, and metadata all remain on your device. We do not receive or store your library. You are the data controller for the personal data in your User Content.

11. Intellectual property

The App, its AI models, and all associated software are owned by DAAAM / Munashe Chitima. You retain all rights in your own media and User Content. We claim no ownership over your footage or AI Output derived from it.

12. Disclaimers and liability

The Services are provided "as is" without warranty of any kind. To the maximum extent permitted by law, our total liability to you will not exceed the greater of (a) the total fees you paid us in the 12 months preceding the claim, or (b) USD 100. These limits do not apply to liability that cannot be excluded by law (e.g. under the Australian Consumer Law).

13. Governing law

These Terms are governed by the laws of Victoria, Australia. Before formal proceedings, contact us at support@daaam.media and we will attempt to resolve the issue within 30 days.

14. Changes

We may update these Terms. Material changes will be notified by email or in-app notice before they take effect. Continued use constitutes acceptance.
